This page explains the HKL Auto Terms and Conditions and Import Policy, including the nature of the service, prices, fees, shipping, documents, and the responsibilities of the customer and the platform.

Welcome to HKL Auto.

By using the website or submitting a request to purchase or import a vehicle through us, you confirm that you have read, understood, and agreed to these Terms and Conditions.

HKL Auto operates through cooperation between HKL Inc. in Osaka, Japan, and Ahmed Mousa Al Hamza Limited Company in Dammam, Saudi Arabia.

This cooperation is intended to provide customers in Saudi Arabia with a clearer and more reliable vehicle import service.

1. Nature of the service

HKL Auto is a platform specializing in listing, sourcing, and importing vehicles from outside Saudi Arabia, particularly from the Japanese market, through cooperation between the Japanese and Saudi entities.

The platform helps customers select vehicles, request quotations, follow purchase or reservation procedures, coordinate with suppliers, track shipping, and receive local support in Saudi Arabia.

HKL Auto is not a government, customs, or official inspection authority and cannot control decisions made by public authorities, ports, customs, shipping companies, or external suppliers.

2. Acceptance of the terms

Using the website, submitting a request, paying a deposit, or confirming a quotation constitutes express acceptance of these terms.

The customer understands that vehicle imports may be affected by factors outside HKL Auto control, including price changes, exchange rates, shipping charges, customs duties, VAT, port charges, inspection requirements, and decisions of public authorities.

3. Prices displayed on the website

Prices shown on the website or in quotations may be estimated, preliminary, or final depending on the vehicle and the wording of the quotation.

A price is final and binding only when the quotation or final invoice expressly says so, vehicle availability and supplier acceptance have been confirmed, and the required customer payment has been received.

4. Price changes during import

Imported vehicle prices may change for reasons outside HKL Auto control, including a supplier price increase, expiry of a supplier offer, purchase by another buyer, auction price changes, shipping rate changes, currency movements, port fee changes, government fee changes, or additional clearance and transport costs.

If the price changes before the final purchase is completed, HKL Auto may notify the customer of the revised price. The customer may accept it or cancel before a final purchase commitment is made.

If the vehicle has already been purchased or money has been paid to a third party with the customer approval, actual non-refundable costs may be deducted from any refund to the extent permitted by law.

5. Additional fees and third parties

The import process may incur additional costs that were not visible or confirmed when the quotation was issued. These may include customs duties, VAT, port, demurrage, storage, delay, inspection, conformity, inland transport, bank, currency conversion, document, clearance, shipping company, government, or regulatory fees.

These charges are payable by the customer unless the quotation expressly states that they are included in the final price.

6. Exchange rates and currencies

Prices may be displayed in US dollars, Saudi riyals, Japanese yen, or other currencies.

The final amount may be affected by the exchange rate applied when payment is made, funds are transferred, or the vehicle is purchased from the source.

Any difference caused by exchange-rate changes, bank transfer charges, or intermediary bank fees is payable by the customer unless otherwise agreed in writing.

7. Quotation validity

A quotation issued by HKL Auto is valid only for the period stated in it.

If payment or confirmation is not completed within that period, HKL Auto may revise the price, issue a new quotation, or cancel the previous quotation without liability.

If no validity period is stated, the quotation is preliminary and non-binding until HKL Auto confirms it in writing.

8. Vehicle availability

A vehicle may be available when listed but sold, reserved, or withdrawn by the source before the customer completes the order.

HKL Auto does not guarantee availability until the supplier confirms it, the required payment is accepted, and an official order confirmation is issued.

If the vehicle becomes unavailable before a final commitment, the customer may request an alternative or a refund, less any actual non-refundable charges paid at the customer request.

9. Vehicle information and specifications

HKL Auto takes reasonable care to present vehicle information accurately, but some details may come from suppliers, auctions, external websites, or inspection reports.

Minor or non-material differences may occur in color shade, equipment, condition descriptions, accessories, images, approximate odometer readings, tire condition, or technical notes.

A minor difference that does not materially affect the vehicle is not automatically grounds for cancellation or compensation. If a clear material difference is discovered before the final purchase, the customer will be informed so that an appropriate decision can be made.

10. Images and reports

Vehicle images and reports are intended to help the customer make a decision and may be supplied by the seller, auction, or an independent inspection provider.

HKL Auto cannot guarantee that every defect or observation appears in the images, especially for used vehicles. Some issues may become apparent only through a physical inspection, operation, or after arrival.

Used vehicles may show normal wear, light scratches, interior wear, paint variation, or technical observations that are not always visible in photographs.

11. Used vehicles

Unless expressly stated otherwise, vehicles listed or imported through HKL Auto are considered used vehicles.

A used vehicle is not in new condition and may show signs of use related to its age or previous operation.

To the extent permitted by law, HKL Auto is not responsible for hidden defects that the supplier did not disclose and that were not visible in the reports or images available at the time of purchase.

12. VIN and documents

The vehicle identification number (VIN) and official documents must be used to confirm the identity of the vehicle.

Document validity and consistency with the VIN are subject to the requirements of the competent authorities. Vehicle import rules require valid documents that match the VIN and show no erasure or alteration. See the Zakat, Tax and Customs Authority guidance.

If an authority rejects a document or requires additional documents or fees, this is outside HKL Auto control and will be handled according to the actual circumstances.

13. Import eligibility and regulatory requirements

Final confirmation that a vehicle is acceptable for import depends on the official procedures and competent authorities in Saudi Arabia.

Imported vehicles are subject to requirements concerning age, category, energy efficiency, condition, documentation, and any other rules issued by the competent authorities.

Certain vehicles may not be imported, including salvage vehicles and vehicles damaged by flooding, collision, fire, rollover, or structural damage, as well as stolen vehicles or vehicles with a manipulated VIN. See the official vehicle import rules.

HKL Auto is not responsible for an official rejection, delay, or additional fee caused by rules, decisions, or requirements outside its control, unless it results from a direct and proven error by HKL Auto.

14. Deposits and payments

HKL Auto may require a deposit or advance payment to reserve a vehicle or begin purchase or import procedures.

A deposit may be used to pay actual costs such as reservation, supplier, auction, document, transfer, or other third-party charges incurred at the customer request.

If the customer cancels after procedures have begun or after a purchase commitment has been made, HKL Auto may deduct actual non-refundable costs to the extent permitted by law.

15. Cancellation and refunds

The customer may request cancellation before a final commitment to purchase from the source, provided that HKL Auto has not paid non-refundable sums or entered into a binding third-party commitment with the customer approval.

After the vehicle has been purchased or reserved, or money has been paid to a supplier, shipping company, or other external party, full cancellation may not be possible or actual costs may be deducted.

These terms do not limit any mandatory consumer rights under the laws of Saudi Arabia.

16. Shipping and arrival dates

Any shipping duration or arrival date provided to the customer is an estimate and not a final guarantee.

Delays may result from shipping companies, port congestion, schedule changes, export procedures, customs, inspections, weather, strikes, public holidays, missing documents, or other circumstances outside HKL Auto control.

HKL Auto is not responsible for indirect losses arising from shipping, clearance, or delivery delays unless the delay results from a direct and proven error by HKL Auto.

17. Demurrage, storage, and delay charges

The customer is responsible for demurrage, storage, or delay charges caused by late payment, late documents, or failure to complete required steps.

Charges caused by an external party, official decision, port, or shipping company will be passed on according to the actual invoices or documents unless otherwise agreed in writing.

18. Customer responsibilities

The customer must provide accurate and complete information, review the quotation before approval, confirm the required specifications, pay on time, provide requested documents, respond to HKL Auto within a reasonable period, and comply with applicable Saudi laws.

HKL Auto is not responsible for delay or error caused by inaccurate information, missing documents, late payment, or failure by the customer to respond.

19. Limitation of liability

HKL Auto liability is limited to services it provides directly and only to the extent that a direct error by HKL Auto is proven.

HKL Auto is not responsible for customs or government decisions, import rejection, changes in law or fees, shipping or exchange-rate changes, supplier or shipping-company errors, port delays, hidden defects in used vehicles, or inaccurate third-party information that HKL Auto did not know was incorrect.

HKL Auto is not liable for indirect losses such as lost profit, business interruption, financing obligations, lost opportunity, or other consequential compensation.

20. Transparency and non-deception

HKL Auto will take reasonable care to present information clearly and avoid misleading statements.

Saudi E-Commerce Law prohibits false offers, statements, or claims and wording that deceives or misleads consumers. See the official legal library.

Estimated or changeable information must therefore be presented as provisional rather than final.

21. Force majeure

HKL Auto is not responsible for delay or failure caused by circumstances outside reasonable control, including natural disasters, war, unrest, strikes, government decisions, port closures, vessel delays, major technical failures, cyberattacks, epidemics, legal changes, or other emergencies that cannot reasonably be anticipated or prevented.

22. Accounts and data

Customers must keep account credentials confidential and must not share their passwords.

HKL Auto uses customer data to fulfill orders, communicate, issue invoices, track shipping, provide support, and meet regulatory requirements.

23. Changes to these terms

HKL Auto may amend these terms from time to time and will publish the updated version on the website.

Continued use of the website or services after publication constitutes acceptance of the amended terms, unless an existing transaction is governed by a specific earlier agreement or quotation.

24. Governing law

These terms are governed by the laws of Saudi Arabia, taking into account the international cooperation between the Japanese and Saudi entities.

Any dispute will first be addressed amicably. If no resolution is reached, it will be referred to the competent judicial or other authority in Saudi Arabia unless a separate written agreement provides otherwise.
